2.1. Data provided during registration. To use the Platform, the User must necessarily provide, at the time of registration, their full name or Corporate Name if a legal entity, CPF or CNPJ, and their email address.

2.1.1. The information and personal data provided will be stored in our systems, confidentially and securely, and will be treated in accordance with this Privacy Policy.

2.2. Data collected during operations. For our services and functionalities to be offered in the best possible way, it is necessary to collect some information, transmitted electronically or entered by Users, such as elements related to the purchase and sale of securities, results of orders executed by our investment robots.

2.2.1. The data collected during operations is currently not used for any purpose other than the provision of the contracted services and the offering of some SmarttBot products via email to the User, if they choose to receive our informational emails. Furthermore, such data is stored appropriately, securely, and in compliance with applicable legislation.

2.2.2. In the future, the collected data may be used to calculate indicators about the User’s investments, as well as to filter the displayed content and send emails to the User as a form of communication, for better service provision and in accordance with the legitimate interests of the Parties.

2.3. SmarttBot may use Cookies, which are small files added to the User’s computer to provide a more personalized experience using the Platform, as well as to perform internal navigation, security, and User preference controls.

3.1. SmarttBot adopts various information security mechanisms for the processing of data provided and collected from Users, to ensure their privacy, authenticity, and inviolability of information, as determined by Law 12.965/14 (“Brazilian Civil Rights Framework for the Internet”) and its respective regulatory decree (Decree No. 8.771/16). Although not yet in force, SmarttBot is also inspired by the provisions of Law No. 13.709/18 (“LGPD”).

3.2. Only restricted and authorized SmarttBot employees have access to the provided and collected data, who are contractually obligated to maintain the confidentiality of this data.

3.2.1. Our database allows for subsequent verification of the employee’s access, indicating the accessed file, duration of access, and the identity of the person who accessed it, ensuring the security of records.

4.1. The User may, at any time and regardless of motivation, change or cancel the sharing of data with SmarttBot, by communicating via email contato@smarttbot.com, in which case any legal requirements will be observed.

4.2. The User’s express consent, through opt-in, guarantees free, informed, and unequivocal agreement with the terms described herein.

4.3. The provided and collected data is also processed to ensure the legitimate interest of SmarttBot and Users in obtaining better service, embodied in the offering of SmarttBot’s services, benefits, and functionalities.

5.1. This Privacy Policy constitutes a complete and perfect legal document to regulate the relationship and may be freely modified by SmarttBot at any time. In such cases, a notice will be sent to Users informing them of any changes. The new Privacy Policy will be valid from the date it is published on the SmarttBot website, reserving the User’s right to remain registered or request the discontinuation of services. If the User does not express their disagreement and/or request the discontinuation of services, SmarttBot will legitimately consider the tacit agreement with the new Privacy Policy.

5.2. The services offered by SmarttBot are available only to individuals who have the legal capacity to contract them.

5.2.1. The User declares and guarantees that they have the capacity to do so, i.e., they are of legal age or are duly represented by their parents or legal representatives.

5.2.2. If the User is a legal entity, they declare and guarantee that they are represented by an individual with sufficient powers to contract SmarttBot, duly stated in a proper instrument, registered with the competent authority.

5.3. Finally, if it is necessary to resolve any doubts or controversies arising from this contract, the elected forum is that of the District of Belo Horizonte/MG, with the waiver of all others, no matter how privileged they may be. This means that, if it is necessary to discuss something in court, the actions must be filed in Belo Horizonte/MG.
